Legal Boundaries
Some requests we get asked for most often are the ones no licensed investigator in New York can legally do. We turn them down every time — not to be difficult, but because doing them would be a crime, the “evidence” would be thrown out of court, and you, the client who asked for it, could be liable too.
We cannot — and will not — hack into or access anyone's phone, text messages, email, social media, or cloud accounts. We will not install spyware or “monitoring apps” on a device that isn't yours, and we will not obtain anyone's phone records. Unauthorized access to a computer or stored communications is a federal crime (the Computer Fraud and Abuse Act and the Stored Communications Act) and a New York crime as well (computer trespass and eavesdropping, New York Penal Law § 250.05). Posing as the account holder to pull phone records — “pretexting” — is also a federal crime. There is no legal version of this service, from us or anyone else.
We will not place a GPS tracker or any other tracking device on a vehicle or property you do not own. Tracking someone without the vehicle owner's consent is unlawful in New York (Penal Law § 120.45), and anything learned from an illegal tracker is unusable in court. If the vehicle is yours, talk to us — we will explain the lawful options.
New York is a one-party-consent state. We do not record conversations we are not a party to, and we do not plant listening devices — that is eavesdropping, and it is a felony.
Everything ELK produces is gathered lawfully, so it holds up: surveillance and observation from public view (Penal Law § 250.45 permits observation in public places), background checks and due diligence through lawful databases and records, skip tracing, and interviews. Every finding is documented to a standard your attorney, your insurer, or the court can rely on. That is the difference between evidence and a liability.
No. Accessing someone else's phone, messages, or accounts without authorization is a federal and New York crime (computer fraud, stored-communications, and eavesdropping laws), and placing a tracker on a vehicle you don't own is unlawful in New York (Penal Law § 120.45) — evidence obtained that way is thrown out and can expose you personally. What we can do is document the same facts lawfully: surveillance from public view, background checks, and documented activity checks that your attorney can actually use.
